Wednesday War Story

notice-clipart-eviction-notice-800x800A single family home was rented out at a decreased rate to a family for a 4 year term. After roughly a year, the family moved out and a cousin & their family moved in. (Though no one informed the manager) When the manager did one of their regular inspections, they found the new family. The manager trying to turn a bad situation into a good situation, asked the new family to fill out applications and proceed with the rental application process to be approved. They refused, stating they were already renting. When the manager called the original tenants, they hung up on him.   So following the law he posted the notice on the door to comply by removing the unauthorized persons from the unit.

 

Long story short, the original tenants ended up with a judgement against them for legal fees, lost rent and damages. The “new” residents who refused to leave, after posting the writ of restitution giving them 3 more days till lock out, were met by the constable and given 5 minutes at that time to grab what they could and leave. To make things worse, they refused to come back and get the property left behind, so the manager proceeded with abandonment law to remove the property from the rental.

 

Sometimes it is ok, to just admit you are in the wrong and LEAVE…
